Letter of Appointment and Contract
We are pleased to offer Kusum Choubey (hereinafter called the Educator) employment as part time educator at UpSkill Classes (hereinafter called the ACADEMY) on the following terms and conditions of employment.
(Please note that the academy reserves the right to make any changes to the below mentioned terms and conditions)
1. Appointment

The educator shall be an employee of the academy from the date of joining i.e.; 17/10/23 until further notice by the academy
2. Compensation
-
The compensation will be provided at the end of each month based on the number of hours of service in the form of sessions and/or classes conducted by the educator

3. Terms of Engagement

The services of the educator shall be such as to enable the academy to benefit from the educator’s knowledge and experience and shall comprise of the educator’s time, attention, ability as may be necessary

The educator shall at all times during the period of the contract carry out the due skill and perform diligently the following services

Use his/her best endeavors to promote the interests of the academy
-
Alert the academy of any other needs of the clients or any substantial information that may be of value or affect the academy and its interests in any which way possible

The educator is liable to provide a thirty-minute demo session/trial session to every incoming/prospective student without charge
-
The educator is responsible to convert the prospective client at this stage to a confirmed client for the academy by carrying out their services in the best manner possible during the demo session
-
The educator shall provide a minimum of three weeks’ notice in writing before dis-associating themselves from the academy and shall continue to work for the academy as per the agreed terms within the period of the notice

The educator will be responsible to provide home-work after each session in the prescribed UpSkill Format and ensure appropriate progress tracking throughout the month and provide a detailed account of student’s progress as per the format and structure in place by the academy

The educator will also be required to perform certain complementary tasks essential for conducting sessions/classes, such as content creation and compiling etc.

The educator must comply to provide the class records and other required data; including test results, feedback of the students and any other necessary information for account management as per the format and structure in place by the academy at the end of each month (or week) as required by the academy.

4. Confidentiality, Non-Compete and Non-Solicitation

The educator shall not at any-time disclose any information including client sensitive information, technical know-how, functional details, administration, knowledge, methods, plan, process etc., pertaining to the academy which is in his/her possession due to their association with the academy

The educator shall not use the content curated by the academy including e-books, practice sheets or any other study material provided by the academy for any other purposes outside of work related to the academy

The educator shall not contact and/or negotiate with any client (student/parent/any other close ally) regarding their association with the academy or any other communication of compensation etc. except that of progress of the student, subject matter, class timings etc.

The educator shall not contact and/or negotiate with any client (student/parent/any other close ally) for any purpose of soliciting such a customer to purchase, lease or license a product or service that is the same as, similar to, or in competition with those products and/or services provided, rendered, offered or under development by the academy

The educator shall not induce or attempt to induce employees or other individuals associated with the academy to terminate employment with the academy and become self-employed or be employed with others in the same or similar service as that offered by the academy
5. Termination
-
The services of the educator are liable for termination if he/she is proven to be medically un-fit to carry out the duties or in case of under-performance

The academy reserves the right to terminate the services of the educator in situations of business slow-down related downsizing activities etc.

The educator will be liable for termination from service without any notice if:

Any declaration given by the educator or testimonials furnished by the educator to the academy proves to be false

The educator is found to have willfully suppressed any material information
-
The educator is found to have been convicted for or indulged in criminal, subversive or immoral activities
-
The educator breached any of the terms and conditions of the services as specified in this document or further communication by the academy
